Competition Terms and Conditions

  1. Promoter 

The promoter is Nelson Festivals Trust, trading as Nelson Arts Festival, of 106 Collingwood Street, Nelson 7010 (“the Promoter”). 

  1. Competition period 

The competition opens at 12.01am NZST on Friday 28 August 2026 and closes at 11.59pm NZST on Wednesday 16 September 2026 (“Competition Period”). 

Entries received outside the Competition Period will not be accepted. 

  1. Eligibility 

Entry is open to New Zealand residents aged 18 years or older at the time of entry. 

Employees, contractors, trustees and immediate family members of the Promoter or participating prize partners are not eligible to enter. 

The winner and their guest must both be aged 18 years or older because the prize includes alcohol. 

  1. Travel dates and requirements 

The winner and their guest must be available to travel from Wellington to Nelson on Saturday 31 October 2026, departing at approximately 7am, and return to Wellington during the afternoon or evening of Sunday 1 November 2026. 

Exact flight times are subject to confirmation and the operating schedule of Sounds Air. 

The winner and their guest are responsible for arranging and paying for their own transport to and from Wellington Airport. 

  1. How to enter 

To enter, eligible participants must complete and submit the official online competition entry form during the Competition Period. 

Entry is free and no purchase is necessary. 

Only one entry per person is permitted. Duplicate, incomplete, automated, fraudulent or incorrectly submitted entries may be disqualified. 

  1. Marketing consent 

Agreeing to receive marketing communications is optional and is not a condition of entry. 

Entrants who choose to receive marketing communications may unsubscribe at any time by using the unsubscribe link provided or by contacting the Promoter. 

  1. Prize 

One winner will receive a Nelson luxury arts weekend for two, comprising: 

  1. One night’s accommodation for two at Pīhopa Retreat on Saturday 31 October 2026, valued at approximately NZ$1,800.  
  1. Two return Sounds Air flights between Wellington and Nelson, valued at approximately NZ$[insert value].  
  1. A six-hour private Wine, Art & Wilderness tour and lunch for two on Saturday 31 October 2026, valued at approximately NZ$860.  
  1. Two tickets to an allocated Saturday evening performance of Machine de Cirque at the Nelson Arts Festival, valued at NZ$158 in total.  
  1. One Neudorf Wines presentation box containing two bottles of wine, valued at approximately NZ$[insert value].  

The total approximate retail value of the prize is NZ$[insert total value]. 

  1. Prize itinerary 

The provisional itinerary is: 

  1. Approximately 7am on Saturday 31 October 2026: Sounds Air flight from Wellington to Nelson.  
  1. 10.30am–4.30pm on Saturday 31 October 2026: private Wine, Art & Wilderness tour, including lunch.  
  1. Saturday evening: Machine de Cirque at the Nelson Arts Festival.  
  1. Saturday 31 October 2026: overnight accommodation at Pīhopa Retreat.  
  1. Afternoon or evening of Sunday 1 November 2026: return Sounds Air flight from Nelson to Wellington.  

The final itinerary, flight times, performance details, accommodation arrangements and other booking information will be confirmed directly with the winner. 

  1. Costs not included 

Unless expressly listed as part of the prize, the winner and their guest are responsible for all other costs associated with accepting and using the prize. These may include: 

  1. Travel to and from Wellington Airport.  
  1. Airport parking.  
  1. Meals and beverages not expressly included in the prize.  
  1. Additional accommodation.  
  1. Personal expenses.  
  1. Travel insurance.  
  1. Changes or upgrades requested by the winner.  
  1. Any other incidental expenses.  
  1. Winner selection 

The provisional winner will be selected by random draw from all valid entries at 12 noon on Thursday 17 September 2026 at the Nelson Arts Festival office, 106 Collingwood Street, Nelson 7010. 

The draw is final, subject to verification that the selected entrant meets these Terms and Conditions. 

  1. Winner notification 

The provisional winner will be contacted using the phone number and email address supplied with their entry. 

The provisional winner must respond and confirm their eligibility, availability and acceptance of the prize within 48 hours of being contacted. 

The Promoter may request reasonable proof of the winner’s identity, age and New Zealand residency before confirming the prize. 

The winner will be publicly announced after they have accepted the prize and their eligibility has been verified. 

  1. Redraw 

If the provisional winner cannot be contacted, does not respond within 48 hours, is unavailable on the required travel dates, does not meet the eligibility requirements or is otherwise unable to accept the prize, the Promoter may withdraw the offer and select another winner by random redraw. 

  1. Guest 

The winner must nominate one guest aged 18 years or older. 

The winner and their guest must travel together on the same itinerary and comply with the reasonable requirements and booking conditions of the Promoter, Sounds Air, Pīhopa Retreat, Wine, Art & Wilderness, Neudorf Wines, the event venue and any other prize partner. 

  1. Prize conditions 

The prize is not transferable, exchangeable or redeemable for cash. 

Prize components are subject to availability and the individual booking conditions of the relevant prize partners. 

The winner may not sell, transfer or commercially advertise any component of the prize. 

Any unused portion of the prize will be forfeited and will not be replaced or reimbursed. 

  1. Changes and substitutions 

If a prize component becomes unavailable for reasons beyond the Promoter’s reasonable control, the Promoter may substitute it with an alternative of equal or greater value. 

The Promoter will make reasonable efforts to preserve the overall nature and value of the advertised prize. 

  1. Cancellation or disruption 

The Promoter and participating prize partners are not responsible for delays, cancellations, missed connections, weather disruption, event cancellation or other circumstances beyond their reasonable control. 

If Machine de Cirque, a flight, tour or another prize component is cancelled or materially changed, any remedy available to the winner will be limited to that offered by the relevant provider, except where otherwise required by law. 

  1. Alcohol 

Alcohol will only be supplied to people aged 18 years or older. Proof of age may be required. 

Alcohol must be consumed responsibly. The wine component may be withheld or replaced if supplying it would be unlawful or inappropriate. 

  1. Conduct 

The winner and their guest must behave responsibly and follow all reasonable safety, travel, venue, accommodation and tour requirements. 

The Promoter or a prize provider may refuse participation or withdraw a prize component if the winner or their guest behaves unlawfully, dangerously, abusively or in a way that may cause harm or significant disruption. 

  1. Publicity 

The winner’s name and region may be published on the Nelson Arts Festival website, social-media channels and other campaign communications after the winner has accepted the prize and their eligibility has been verified. 

Any additional photography, filming, interview or promotional participation will be discussed with the winner and undertaken with their consent. 

  1. Personal information 

Personal information collected through the competition will be used to: 

  1. Administer and verify entries.  
  1. Draw and contact the winner.  
  1. Arrange and deliver the prize.  
  1. Prevent fraudulent or duplicate entries.  
  1. Send marketing communications where an entrant has separately chosen to receive them.  

Information may be shared with prize partners and service providers where reasonably necessary to administer the competition or deliver the prize. 

Personal information will be handled in accordance with the Privacy Act 2020 and the Nelson Arts Festival privacy policy, available at nelsonartsfestival.nz/privacy-policy. 

Entrants may request access to or correction of their personal information by emailing info@nelsonartsfestival.nz. 

  1. Technical problems 

The Promoter is not responsible for entries that are lost, delayed, corrupted or not received because of technical problems outside its reasonable control. 

The Promoter may verify entries and disqualify any entrant who interferes with the entry process or submits an entry using automated, misleading or fraudulent means. 

  1. Modification or cancellation 

If the competition cannot operate as planned due to circumstances beyond the Promoter’s reasonable control, the Promoter may modify, suspend or cancel it. 

Any material change will be communicated through the competition webpage where reasonably practicable. 

  1. Liability 

To the maximum extent permitted by law, the Promoter and participating prize partners will not be liable for any loss, damage, expense or injury arising from entry into the competition or acceptance and use of the prize, except where that liability cannot legally be excluded. 

Nothing in these Terms and Conditions limits any rights or remedies that cannot be excluded under New Zealand law. 

  1. Social-media platform disclaimer 

This competition is not sponsored, endorsed, administered by or associated with Meta, Facebook, Instagram or any other social-media platform on which it is promoted. 

Entrants release those platforms from any responsibility associated with the competition to the extent permitted by law. 

  1. Acceptance of these terms 

By entering the competition, entrants confirm that they have read, understood and accepted these Terms and Conditions. 

  1. Governing law 

These Terms and Conditions are governed by New Zealand law, and entrants submit to the non-exclusive jurisdiction of the New Zealand courts.
